TERMS AND CONDITIONS

Hawley and Hazel Asia Investment Company Limited (“Company”) will run the SUMIKKOGURASHI DOUBLE ACTION (“Campaign”) from 2 April 2021 00:00:001 Hong Kong Time  to 5 May 2021 23:59:59 Hong Kong Time (“Campaign Period”).  Anyone who participates in the Campaign (“Participant”)shall agree with all the terms and conditions herein.

The Campaign

  1. The Participants shall read the instructions of the Campaign on this Website before participating in the Campaign. The Company has the right to revise the said instructions from time to time during the Campaign Period. The Participants shall not raise any objections.

  2. The Participants may scan the QR CODE at the designated locations or on the designated products through their mobile phones in order to download the calendar wallpapers, capture images, and earn points.  After scanning the QR CODE at a specific location, the Participants will obtain fixed (but not random) images and points. When a Participant accumulates a certain number of points and captured specific images, he/she may redeem prizes according to the instructions of this event. Please click this link (http://doubleactionar.darlie.com.hk/) for details. The Participants are required to collect and accumulate points before the expiry of the Campaign Period. All the points will become invalid upon expiry.
  3. Once the Participants has accumulated a specific number of points, he/she may apply for and register for prize redemption within 20 May 2021 23:59:59 Hong Kong Time (“Redemption Period”) in accordance with the instructions on this Website. The prizes are distributed on a first-come-first basis, while stocks last. A message will be popped up on the Website if no stocks are available.

  4. There will be three levels of prizes. If the Participants fail to (i) make an online registration within the Redemption Period and/or (ii) present the original packaging box of SUMIKKOGURASHI DOUBLE ACTION Special Edition upon redemption, the Participants will not be qualified to redeem the grand prize and the second prize. For the avoidance of doubt, the Participants are not required to make any online registration nor present the said packaging box for redemption of the third prize.

  5. Participants shall follow the instructions in the redemption email to redeem prizes at the designated time and place.

  6. Each Participant can only redeem each level of the prize once.

  7. All points and prizes cannot be returned and/or exchanged for cash.

  8. The Company has the right, without any compensation, to disqualify the Participant from the Campaign immediately without any prior notice in the following events:

    i) 
    any Participant is in breach of these Terms and Conditions or commits any illegal, dishonest, or improper acts in participation of the Campaign.; and/or

    ii) 
    are not eligible or unable to provide proof of eligibility to participate in the Campaign for verification when Company requested.
  9. The Company has the absolute discretion to suspend, modify or terminate this Website and/ or the Campaign without any prior notice.

  10. Employees of the Company and their immediate family members [children, parents, siblings, including spouses] are not eligible to participate in this Campaign.



  11. Save and except those otherwise mentioned hereinbelow, the intellectual property rights of all images and designs on this Website are owned by the Company. No reproduction, republication, upload, copy, transmit, distribution, display, or otherwise use of any of the image/designs and other Company’s materials on this website is allowed or permitted without the prior written consent from the Company.

  12. All images, designs, and products in this Campaign may be subject to copyright owned by any third party. The Participants shall not reproduce or sell the images, designs, and products obtained in this Campaign (including but not limited to the calendar wallpaper) for commercial purpose without the consent of the relevant copyright owner.


    Disclaimers

  13. This Website is provided “as is” and without warranties of any kind either express or implied. To the fullest extent permissible pursuant to applicable law, the Company disclaims all warranties, express or implied, including, but not limited to, system integration and freedom from computer virus. The Participants use the Website at his/her own risk.

  14. The Company is not a manufacturer/ supplier of prizes and does not make any representations,  explicit or implied warranties on the quality, safety, and applicability of the prizes.

  15. Unless stipulated otherwise, all transportation cost, internet charges, personal expenses and/or any other costs, fees and/or any kind of expenses incurred by the Participants in connection with this Campaign  (whether for the purpose of joining, participating in or receiving any benefit or prizes from the Campaign) are the sole responsibility of the Participants. The Company, its affiliates, agents or participating agencies shall not be responsible whatsoever for the said costs, fees and expenses.

  16. The Participant acknowledges that his/her participation in the Campaign shall be at his/her own risks.

  17. The Company, its affiliates, sponsors, agents and their respective directors, officers, employees, agents and assignors shall not be liable and/or responsible to any Participant for the following events. The Participant agrees to release, discharge and hold harmless the aforementioned parties in the event that:

    i) 
    the Participant’s  failure to win a prize in the Campaign for whatsoever reasons;

    ii) 
    the prizes of the Campaign are being defective;

    iii) 
    any loss, damages, costs, expenses, claims, liabilities, injury, death or accidents suffered by the Participant during the Campaign or arising out of or in connection with the Campaign and/or redemption or use of the prizes;

    iv) 
    any delay and/or failure in receiving,sending or downloading any materials of the Camaign as a result of any network, communication, or system error, interruption and/or failure;

    v) any error of the Website (including error in notification of Campaign winners), omission, interruption, deletion, defect, virus and unauthorized access; abd/or

    vi) any other matters outside the Company’s reasonable control.



  18. If any of the provisions in these Terms and Conditions are deemed invalid, illegal, or for any reason unenforceable, that provision will be ineffective and deemed severable and will not affect the validity and enforceability of the remaining provisions of these Terms and Conditions.
  19. These Terms and Conditions and the instructions of the Campaign may be amended or modified from time to time. Any changes will be reflected on this Website. The Participant shall check this Website from time to time.

  20. The Contracts (Rights of Third Parties) Ordinance (Cap. 623) shall not apply to these Terms and Conditions. No person other than the parties to these terms and conditions shall have any rights under it nor shall it be enforceable by any person other than the parties to it.

  21. These Terms and Conditions are governed by and shall be construed in all respects in accordance with the laws of the Hong Kong Special Administrative Region all the parties hereto hereby submit to the exclusive jurisdiction of the Hong Kong courts in connection with any matters arising hereunder.

  22. Should there be any differences or inconsistencies between the Chinese version and the English version of these Terms and Conditions, the English version shall prevail.

  23. If there is any dispute over Campaign or these Terms and Conditions, the Company shall have the final decision.
